HOPLOCATION TERMS AND CONDITIONS

1. INTRODUCTION

Welcome to Hoplocation ("we," "us," "our," or "the Platform"). These Terms and Conditions ("Terms") govern your access to and use of the Hoplocation website, mobile application, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

Hoplocation is an accommodation booking platform that connects travelers with short-term rental properties in South Africa. We facilitate bookings and offer integrated split payment functionality through Payflex and Happy Pay to make travel more accessible and affordable.

2. DEFINITIONS

  • "Guest" means any person who books accommodation through the Platform.
  • "Host" means any property owner or manager who lists accommodation on the Platform.
  • "Property" means any accommodation listed on the Platform, including homes, apartments, and unique stays.
  • "Booking" means a confirmed reservation of a Property through the Platform.
  • "Payflex or Happy Pay" means our third-party split payment provider that enables installment payments.

3. ACCEPTANCE OF TERMS

By creating an account, making a booking, or using our Service, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding contract.

You agree to provide accurate, current, and complete information during registration and booking.

We reserve the right to refuse service, terminate accounts, or cancel bookings at our sole discretion if we suspect fraudulent activity or breach of these Terms.


4. USER ACCOUNTS

4.1 Account Registration

To make a booking, you must create an account by providing your name, email address, phone number, and creating a secure password. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Security

  • You are solely responsible for all activities that occur under your account.
  • You must immediately notify us of any unauthorized use of your account.
  • We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 Account Termination

You may close your account at any time by contacting our customer support. We may suspend or terminate your account if you breach these Terms or engage in fraudulent or illegal activity.


5. BOOKING PROCESS

5.1 Searching and Booking

  • Guests can search for Properties based on location, dates, number of guests, and amenities.
  • All Property information, including photos, descriptions, amenities, and pricing, is provided by Hosts. We do not guarantee the accuracy of this information.
  • Once you submit a booking request, you will receive a booking confirmation via email upon successful processing.

5.2 Booking Confirmation

  • A booking is confirmed only when you receive a booking confirmation email from Hoplocation.
  • The confirmation email will include booking details, Property information, check-in/check-out times, and payment information.
  • Properties are subject to availability. We reserve the right to cancel bookings if a Property becomes unavailable.

6. PRICING AND PAYMENT

6.1 Pricing

  • All prices are displayed in South African Rand (ZAR) and include applicable taxes unless otherwise stated.
  • The total booking price includes the nightly rate, cleaning fees, service fees, and any additional charges specified by the Host.
  • Prices are subject to change without notice, but confirmed bookings will honor the price at the time of booking.

6.2 Payment Methods

We accept payment via credit card, debit card, and split payment through Payflex and Happy Pay. All payments are processed securely through our third-party payment processors.

6.3 Split Payment Option 

  • Guests may choose to split their payment into multiple equal installments using Payflex and Happy Pay, according to their individual terms and conditions.
  • The first installment is due at the time of booking. The second and third installments are automatically deducted according to the payment schedule provided by Payflex and Happy Pay.
  • Failure to make installment payments may result in booking cancellation and additional fees imposed by Payflex and Happy Pay.
  • Pay Just Now's terms and conditions apply to split payment transactions. Hoplocation is not responsible for issues arising from Payflex and Happy Pay services.

7. CANCELLATION AND REFUND POLICY

7.1 Guest Cancellations

  • Under no circumstances will keys be given to the guest until 100% of the booking is paid.
  • Cancellation of the booking more than 7 days before checkin date will result in a 70% refund.
  • Cancellation of the booking within 7 days of checkin date will result in a 70% refund.
  • Cancellation of the booking within 3 days of checkin date will result in a charge of 100% of the booking value and no refund.

7.2 Host Cancellations

If a Host cancels a confirmed booking, Guests will receive a full refund of the booking value. Hoplocation will make reasonable efforts to assist Guests in finding alternative accommodation.


8. PROPERTY STANDARDS AND HOST OBLIGATIONS

Hosts are responsible for ensuring that Property listings are accurate, up-to-date, and comply with all applicable laws and regulations. Hosts must maintain their Properties in a safe, clean, and habitable condition. Hoplocation is not liable for the condition, safety, or legality of any Property listed on the Platform.


9. PRIVACY AND DATA PROTECTION

We collect, use, and protect your personal information in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA). By using our Service, you consent to the collection and use of your data as described in our Privacy Policy.


10. DISCLAIMERS AND LIMITATION OF LIABILITY

The Service is provided on an "as is" and "as available" basis without warranties of any kind. To the fullest extent permitted by South African law, Hoplocation shall not be liable for any indirect, incidental, special, consequential, or punitive damages.


11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any legal action shall be brought exclusively in the courts of South Africa.
